DCA encourages public comments on pending regulations or regulation changes. If you are interested in submitting comments on a regulation at any time, please mail or e-mail your comments to DCA at the addresses provided below.

Public Participation in the Rulemaking Process:

The public may participate in the rulemaking/regulatory process by submitting written comments to DCA at any regulatory hearing on a rulemaking proposal. When DCA proposes to adopt, amend, or repeal one of its regulations (Title 16, California Code of Regulations, Division 38, commencing with section 3800), the public is provided an opportunity to submit written comments during the noticed public comment period. Written comments may also be submitted to DCA, either at any public meeting or by submitting them to the DCA Legal Division by mail, facsimile, or e-mail to the addresses below:

Approved Regulations

Legal Document Assistant Registration Form and Contract:

On January 3, 2022, the Office of Administrative Law approved the Department of Consumer Affairs' proposed action to amend Article 1, Chapter 5, Division 38 of Title 16, California Code of Regulations (CCR) section 3950. This amendment is adopted in compliance with Title 1, Division 1, Chapter 1, Article 2, section 100(b)(3), of the CCR, and does not materially alter any requirement, right, responsibility, condition, prescription, or other regulatory element of any CCR. This regulatory action became effective on January 3, 2022.

On October 26, 2020, the Office of Administrative Law approved the Department of Consumer Affairs' proposed action to amend Article 1, Chapter 5, Division 38 of Title 16, California Code of Regulations (CCR) sections 3900 and 3950. These amendments are adopted in compliance with Title 1, Division 1, Chapter 1, Article 2, section 100(b)(3), of the CCR, and do not materially alter any requirement, right, responsibility, condition, prescription, or other regulatory element of any CCR. This regulatory action became effective on October 26, 2020.

Unlawful Detainer Assistant Standard Contract:

On August 25, 2020, the Office of Administrative Law approved the Department of Consumer Affairs' proposed action to amend Article 2, Chapter 4, Division 38 of Title 16, California Code of Regulations (CCR) sections 3890 and 3950. This amendment is adopted in compliance with Title 1, Division 1, Chapter 1, Article 2, section 100(b)(3), of the CCR, and does not materially alter any requirement, right, responsibility, condition, prescription, or other regulatory element of any CCR. The amendments must be made for the regulation to be consistent with existing law. This regulatory action became effective on August 25, 2020.

Conflict of Interest Code:

This is a Conflict of Interest Code (COI) that has been approved by the Fair Political Practices Commission. On August 4, 2020, the Office of Administrative Law authorized the filing and printing of this COI, published the regulation, and transmitted it to the Secretary of State.

The Department of Consumer Affairs' regulation to amend section 3830 of Division 38 of Title 16, California Code of Regulations (CCR) became effective on September 4, 2020.
